Nicole Richie seems to keep getting herself in trouble, and this time she might have to do a little jail time, and she's terrified. When she and Paris Hilton were seen at Mr. Chow's last week, onlookers noticed that Hilton seemed to be comforting her on-again/off-again friend.

Richie was arrested on a DUI in early December for driving the wrong way down a California freeway. When officers caught up to her she was parked facing the wrong way in the carpool lane talking on her cel phone. After failing a field sobriety test, the 25 year old admitted to having smoked marijuana earlier in the evening, and had taken a Vicodin.

Richie is the proud recipient of a previous DUI from 2002, and if convicted of a second offense, it carries with it a mandatory jail sentence of a whopping five whole days. Richie would also lose her license for a year, and be ordered to attend an alcohol education program for a year-and-a-half, even if the second conviction is not alcohol-related.


A source told Life and Style Weekly magazine, "She was really freaking out. Paris kept telling Nicole not to worry, that everything was going to be fine."
