It pays to have a live-in lawyer, because the fight between Anna Nicole Smith and Larry Birkhead just keeps getting dirtier. In a pretty masterful maneuver, Smith's camp is threatening to sue Larry Birkhead if he continues talking to the media about his and Anna Nicole's former relationship.

Smith and Howard K. Stern, her lawyer, insist that Birkhead signed not one, but three confidentiality agreements, and have produced papers which appear to have his signature and initials. For his part, Birkhead claims never to have seen any agreements. Entertainment Tonight obtained a copy of one of those agreements, which is entitled "Agreement Not To Communicate With The Media". The piece of paper also includes a handwritten addendum that states, "If I breach this agreement then I will pay a liquidated damages sum of ten million dollars, and any money received would revert back to Anna Nicole Smith as damages from any breach."

Birkhead and Smith are embroiled in a court battle over his alleged paternity of Smith's baby, Dannielynn. Birkhead insists he is the father, while Smith swears that he is not, and rather, her lawyer, Stern, is the father. Stern's name is on the Bahamian birth certificate for the little girl, but could be charged with fraud if it is discovered that he knowingly signed his name without being the father.

Smith and Stern have so far blocked the court's attempts to force her to produce the baby for a DNA test.
